HARYANA ELECTRICITY REGULATORY COMMISSION

ORDER

 

The Petitioner (s), Renewable Energy Department, Haryana & Haryana Renewable Energy Development Agency (HAREDA) and M/s India Solar Energy Pvt. Ltd. have submitted as under:

 

HAREDA’s Petition:

 

1.            HAREDA has in its petition requested the Commission to allow the power utilities to purchase solar power from NVVN along with bundled conventional power under JNNSM at the tariff determined by CERC on yearly basis for Solar PV & solar thermal power projects.

 

2.            In addition to above, the Petitioner submitted that the tariff for purchase of solar power from Rooftop & Smaller Solar Power Plants under generation based incentive scheme may be determined on the basis of the tariff fixed by CERC on yearly basis.

 

3.            It was prayed that the leveled tariff as approved by the CERC may be adopted and made applicable for 25 years for the above mentioned categories of generators. 

 

4.            In order to promote power generation from new and renewable sources in Haryana, HAREDA, requested that the Commission may determine Solar Renewable Purchase Obligation i.e. 0.25% for 2010-11 & annual increase of 0.25% i.e. 3% for year 2022 under Renewable Purchase Obligation.

 

5.            On the issue of Grid Connectivity for the solar projects to be set up under Rooftop PV and other small Power Plants (RPSSGP), the petitioner submitted that:

 

(i)        Projects above 5 MW under bundling scheme through NVVN to be connected at 33 KV and above on transmission network.

 

(ii)       Projects in the range of 1 MW under Generation based incentive (GBI) scheme to be connected below 33 KV level on distribution network. 

 

(iii)      Expenditure to borne by the utilities towards grid connectivity.

 

 

M/s R.S.India Solar Energy Pvt. Ltd.’s Petition:

 

            M/s R.S. India Solar Energy Pvt. Ltd. vide their petition dated 23rd March 2010 submitted as under :-

 

1.            As per Commission’s order dated 25th April, 2008 the tariff for solar plants commissioned upto 31st December, 2009 shall be Rs. 15.96/ kWH and for the plants commissioned thereafter the tariff shall be Rs. 15.16 / kWH. In view of these orders of the Commission the proposed solar plant, which falls under the new guidelines circulated by MNRE, may not qualify for registration for participating in the new generation based incentive scheme. The relevant provisions quoted by the petitioner is reproduced below:-

 

“The local distribution utility in whose area the plant is located, would sign a Power Purchase Agreement (PPA) with the Project Proponent at a tariff determined by the appropriate State Electricity Regulatory Commission (SERC)

 

Explanation: Project schemes from States wherein Tariff tenure for duration of 25 years with tariff structure on levellised basis has been determined by SERCs shall alone be considered to be eligible to participate in this program (RPSSGP).”

 

2.       It has been pointed out by the petitioner that Para 3.14, 3.2.1, 3.2.4 and 3.2.5 of the guidelines are also relevant along with the Para reproduced above with the explanation provided therein. It is requested that the guidelines may be examined along with Commission’s order dated 25th April, 2008 and contradiction, if any, between the two i.e. national guidelines and the Commission’s order may be resolved. 

 

The Commission in the light of the petitions filed by HAREDA (the nodal agency for development of renewable energy in the State of Haryana), M/s R.S. India Solar Energy Pvt. Ltd. and the national policy guidelines, has re-examined the order dated 25th April, 2008. The Commission observes that the Project Proponents/ developers interested in registering their projects under RPSSGP may not be eligible as per the existing solar tariff orders dated 25th April, 2008 of the Commission. Therefore, in line with the Jawaharlal Nehru Solar Mission (JNNSM) guidelines for implementation of bundling scheme of NVVN and Rooftop PV and other Small Solar Power Plants (RPSSGP) connected to distribution network (below 33 KV) under JNNSM, the Commission orders as under :

           

 

1.            Allowing Distribution Licensees (s) to purchase solar power from NVVN :-

 

The Commission has examined at length HAREDA’s submission on the above issue and is of the considered view that in line with the provisions of the Electricity Act, 2003, the Commission shall approve power purchase volume, source and tariff including power procurement from renewable energy sources, on receipt petition from the distribution licensees i.e. UHBVNL and DHBVNL.

 

2.         Tariff of Solar Power:-

 

The Commission has considered the submission with respect to tariff of Rooftop and Small Power Plants and orders that for renewable energy projects commissioned up to 31st March, 2013 under Rooftop PV and other Small Solar Power Plants scheme, the applicable tariff shall be the levellised tariff (for 25 years) as determined by CERC including the annual tariff determined from time to time for such projects.

 

3.         Renewable Purchase Obligation (RPO):-

 

The Commission determines as under:

 

(i)            The overall RPO from all non-conventional sources of power shall be 1% of the energy sales to the consumers in Haryana by the distribution licensees i.e. UHBVNL and DHBVNL till the Commission, by way of Regulations or specific order, cha

(ii)           nges the same depending upon the availability of renewable energy in the State of Haryana as well as at National level. 

 

(iii)          Solar RPO for FY 2010 -11 shall be 0.25% of the overall RPO as determined above with an annual increase of 0.25% i.e. 3% for the year 2022.

 

4.         Grid Connectivity :

 

The Commission, for the limited purpose of the power projects to be set up under RGSSGP and for the purpose of implementation of bundled conventional power under JNNSM, orders that;

 

(i)            Projects above 5 MW under bundling scheme through NVVN shall be connected at 33kv and above.

 

(ii)        Projects in the range of 1MW to 3MW under Generation Based Incentive Scheme (GBI) shall be connected at below 33 KV and

 

(iv)         As per provision of Para 4.2 of the RPSSGP guidelines and for the purpose of implementation of bundled conventional power under JNNSM, the distribution licensee shall provide necessary approvals and infrastructure for evacuation of the power generated by the above mentioned power projects.

 

5.         The Petition filed by M/s R/S/ India Solar Energy Pvt. Ltd is also disposed of accordingly in light of above orders of the Commission.
